Vodafone's attempt to have its day in court has been delayed as the judge hearing the network operator's case has reserved his decision.

Vodafone is appealing to the High Court in Auckland to allow it to challenge the Telecommunications Commissioner's ruling on how much Vodafone would have to pay Telecom under the terms of the Telecommunications Service Obligation (TSO).

Vodafone has been called upon to pay over $12 million for its share of the TSO, however the company was late filing its objection to the ruling because its law firm, Bell Gully, revealed it had a conflict of interest as it also worked for TelstraClear.

The judge is expected to give his decision in a fortnight.
