TelstraClear wins case brought by former partner

Court rules $270,000 payment must be made by October 1

TelstraClear has prevailed in a case brought by former reseller partner Global Integration, in which Global Integration sought to have a statutory demand against it by TelstraClear set aside.

TelstraClear claims Global Integration owes it nearly $270,000, but Global Integration applied to have the demand set aside on several grounds.

Among those were that its obligations to TelstraClear had been transferred to another company, that there was a substantial dispute as to whether the debt was owed and that it had a counter claim alleging failure by TelstraClear to provide services as specified in the contract.

However, none of the grounds were accepted by Associate Judge Lang, who ruled in the Auckland High Court earlier this month that Global Integration must pay TelstraClear the amount — $269,735.60 — by October 1 and, failing that, TelstraClear could make an application to have Global Integration liquidated.
